To no one’s surprise, Nintendo sued a company… again. While not for gaming this time, it was due to what they considered an infringement on their name for their game called Super Mario Bros.
Nintendo’s Lawsuit
For those living under a rock, Nintendo is a large Japanese-based company that owns several names and trademarks, including Pokemon, Super Mario, Legend of Zelda, and more. This titan of a company has been around for ages at this point and even used their power to stop others from using their trademarks and slender their name. One recent power move they are pursuing is against Palworld, against the company known as PocketPair, for using some trademark mechanics in their game.
Nintendo came across a small “Super Mario” market in Costa Rica. Fortunately, or unfortunately, depending on how you feel about Nintendo’s current status of stomping out the little people, their new lawsuit did not succeed the way it wanted to. For some background information, a Costa Rican grocery store that is run by Mario Alfaro is registered under the name Super Mario for international class 35, allowing the name Super Mario to be used under food marketing.
Nintendo’s trademark for Super Mario is classed in clothes, games, and accessories. Since it is not legally under the Food Marking trademarks, it was made legal for Mario to use the name and set it as his trademark. Legally, Nintendo can’t do anything about it and fortunately lost their lawsuit. Proving a titan like them can be taken down when they decide to overstep their boundaries.
Is it a good thing? It can be, that while it is understanding that they want to defend their name(s) it needs to be proven that not everything will go into their court, literally and figuratively. Some can say they are merely defending their spot at the top but others say they are bullying others to make sure they stay on top. I love many of their creations mainly Pokemon, but I can’t feel like they are partly bullying to remain at the top.
Nintendo revealed their next Switch, the Nintendo Switch 2. It looks amazing, along with a bunch of upgrades that will surely have their fans looking forward to getting their hands on it.
